Incident Report: The Drowning of Rocco Wright

Rocco Wright drowned at the David Lloyd Club in Leeds when he was three on 21 April 2018. The toddler was at the site with his sister and dad. The family were attending a swimming lesson in the indoor pool for Rocco's sister when Rocco left his father's side, walked around the pool, and entered the water undetected by his father, lifeguards or other pool users. Rocco was a non-swimmer. Rocco was underwater for around two minutes before his father noticed he was missing and began searching the pool for him. Rocco's father saw him in the water at the pool's far end. He jumped in and pulled him out.
One lifeguard was providing constant poolside supervision over the indoor pool. The lifeguard was attentive throughout the incident. When Rocco's father entered the water, the lifeguard proceeded around the pool promptly to assist. The lifeguard, supported by colleagues, performed CPR. Rocco was taken to hospital. Unfortunately, he passed away later the same day.
The investigation revealed that staff had previously raised concerns about the reliance on a single lifeguard to supervise the pool. Lifeguards were also expected to perform other duties like testing the pool water. Glare on the water also obstructed the visibility of parts of the pool. David Lloyd had failed to put in place a bespoke risk assessment to represent the specific needs of the Leeds pool.
The pool operator, David Lloyd, was prosecuted by Leeds City Council for a breach of section 3(1) of the HSWA 1974. An early inquest into Rocco's death was held in 2020, and his death was ruled accidental. David Lloyd initially pleaded not guilty but later admitted liability at Leeds Crown Court. David Lloyd was sentenced on 1 August 2023. A previous fine of £330,000 in 2016 was taken into account.
David Lloyd was fined £2,550,000 and ordered to pay costs of £258,355.80. The fine was reduced from £2.9m due to David Lloyd's guilty plea. Judge Phillips said, as reported by the Mirror (Beever and Corcoran, 2023; Frame, 2023):
"David Lloyd Ltd failed to take practicable steps to eliminate or reduce the risk of drowning. David Lloyd admitted to failing to put in a bespoke assessment to tailor to the specific needs of the Leeds pool. While often having two lifeguards on duty, the club also said only one had been one on that day. Central to this tragedy is the grief of Rocco Wright’s family. Anyone reading these statements supplied by Rocco Wright’s distraught parents, could not failed to be moved by the grief and suffering his drowning has occasioned.
The culpability is I find high. David Lloyd Ltd fell far short of the standard, by failing to put in place the measures that are recognised standards in the industry and by ignoring concerns raised by employees."
The judge reinforced that there was no blame to be attributed to the lifeguard working that day.
